YOU hit someone else's car. It doesn't matter that the other person might have made some legal move that resulted in your hitting her. It's YOUR responsibility to watch for such moves and avoid an accident.

As you were the one backing out, the other driver would be considered to have the right of way. You would be at fault. Had you called the cops, they might have taken an accident report, but they would not have placed blame on either driver. A parking lot is private property so 90% of the laws do not apply while you are driving on private property. (They could still ticket you for being intoxicated and driving, but most others laws do not apply.) If you were to file with your insurance company, each driver would most likely be paid by their own insurance. But as you did not file an accident report, you can not file a claim.

You backed up into another car you did not see. You said that. This is your fault. And it sounds like you drove away - no Police report, "minor scratches but not a lot to freak out call the cops and do an insurance claim" and if you decided that and did not speak with the driver or at least leave your contact information on the vehicle you hit, you did a "hit and run"... also illegal. I have every confidence if YOUR vehicle had been hit by someone who took off leaving "only minor scratches", you'd be freaking out and angry because someone damaged your car...

No one said it is easy to back up safely. And you don't have to do anything "wrong" to hit something when you back up; there are too many directions you need to be looking all at the same time. Nevertheless, you hit it and it's your fault. That's why you buy insurance.

One helpful detail would be your jurisdiction. As a general rule, the driver of the car that is backing up is responsible for the damages. If you can prove that the other driver intentionally placed their vehicle ("sped up") to cause the accident then you might escape liability.

Technically, you're at fault but the other driver probably contributed. While it is important to check the sides momentarily, because you did not go back to looking behind you, therein lies the crux of the situation. You're also at fault for not looking beyond the immediate vicinity of your vehicle. This is called lack of situational awareness. One other thing. Most parking lots are private property and the police cannot and do not issue tickets for accidents that do not occur on public roadways.

Can't tell. The burdened car is the one that has the best view of the other car. As you were backing out, I presume the other car had the better view. So it should have given way to you as you backed up and out. Most accidents in parking lots happen because the cars who have not yet parked are traveling up and down the lanes way too fast. They can't stop in time when a car backs out of its parking slot. And to a point, they are looking well ahead for that open parking slot rather than looking out for cars near by that might be backing out.
