She has not been seen since her cancer surgery which was Dec 21, the same day as the shutdown started. When she did not join the court in January the Republicans speculated that she was "waiting to die". Initially the Dems were denying it. However, as the weeks have moved on, there is no longer "noise" from the democrats. Bryon White took a two year leave of absence for illness from the court waiting until Billy Clinton was in office before retiring. It was his retirement that led to RBG being appointed.
